A federal judge in a trial in the state of Andorra on Wednesday ordered the company to pay a $1.2 billion penalty for infringing the patent on Viagra, which Pfizer Inc., the world’s largest drugmaker, said it had won.
Prosecutors in the state ordered that Pfizer stop the company from marketing its drug, which is sold in Brazil, as a counterfeit drug. It was not clear how much the company would have to pay to get the drug approved.
The judge also ordered that the company pay the state’s legal fees to conduct the trials and to settle other civil cases that had already been settled. That was the end of the case.
The company is appealing the decision.
Brazil’s attorney general said Thursday that the company is seeking $1.5 billion to settle the legal battle over its patent.
“The Brazilian government has taken the steps we are taking to defend its rights,” the attorney general said.
According to Brazilian law, the government must pay the “costs” of litigation, including the criminal penalty and attorney fees.
Brazilians can expect to file a lawsuit with the country’s attorney general’s office and the attorney general’s office. However, the case is still pending.
